ARE YOU CHARGED WITH A GUIDELINES OFFENSE?

The Supreme Court has said that federal and state sentencing guidelines are only advisory, not mandatory. But BEWARE--most judges will almost always sentence you within the guidelines. And your prior record can make the difference between a probationary guideline and one that carries a lot of jail or prison time. Our attorneys know how to navigate the guidelines, avoid mandatory jail terms, and make sure you get the best possible deal from your case, even when it can't be a Not Guilty.

HOW DO THE SENTENCING GUIDELINES WORK?

Sentencing guidelines are calculated by determining the seriousness level of the offense, your offender score and any aggravating factors, and then using one of three matrices (Person offenses, Drug offenses, or Property offenses), and then determining the guidelines range. But, there is also more to it--for instance, Cleckner LLC attorneys will make the right arguments to the Court to ensure that any offense or offender points that should NOT be counted against you AREN'T counted against you.
